These Terms of Service (the “Terms”) govern your use of the website emeraldmassageclinic.com and the booking, spa, and wellness services provided by Emerald Massage Clinic & Spa Inc. (“Emerald,” “we,” “us,” or “our”). By using this website, requesting an appointment, or receiving services from us, you agree to these Terms. If you do not agree, please do not use the website or our services.

2. Our services

We provide professional massage therapy, spa treatments, and related wellness services. Some services may be performed by a Registered Massage Therapist (RMT); others are relaxation or spa services that are not regulated health services. Where a service is eligible for insurance receipts, this will be confirmed with you directly. Service availability, durations, and providers may change.

3. Appointment requests & confirmation

You are responsible for providing accurate contact details so we can reach you. If we cannot confirm your requested time, we will offer the closest available alternative. You may also book or change an appointment by phone during business hours.

4. Pricing, taxes & payment

• Prices shown on the website are estimates for the selected service and duration and may be subject to change.
• Applicable taxes (including HST) are added as required by law.
• No payment is collected online. Payment is made in person at the clinic at the time of your appointment, unless we have arranged otherwise with you directly.
• We accept the payment methods displayed at the clinic. Insurance receipts are issued only for eligible services performed by a qualified provider.

5. Deposits

A deposit secures your appointment: 10% of the service fee for online bookings, or $10 by phone or walk-in. The deposit goes toward your final payment. It is refundable when you cancel or reschedule with at least 12 hours’ notice; otherwise it may be forfeited, as set out in the cancellation policy below.

6. Cancellation, rescheduling & no-show policy

We hold your appointment time exclusively for you, so timely notice lets us offer the slot to other clients.

• Please give at least 12 hours’ notice to cancel or reschedule; cancelling with less notice may forfeit your deposit.
• You can cancel or reschedule using the secure link in your confirmation email, or by calling us.
• With less than 3 hours’ notice, or for a no-show, the full service rate may be charged and any deposit forfeited, at our discretion.
• Repeated late cancellations or no-shows may require a deposit for future bookings.

Note: The exact notice window shown to you during booking is the one that applies. We will always tell you the current policy when you book.

7. Late arrivals

If you arrive late, we will do our best to provide your full treatment, but your session may be shortened so we can stay on schedule for the next client. The full service price may still apply.

8. Health, safety & medical disclaimer

• Massage and spa services are provided for relaxation and general wellness. They are not a substitute for medical diagnosis, advice, or treatment. Always consult a physician for medical concerns.
• You agree to disclose, honestly and completely, any health conditions, injuries, allergies, medications, pregnancy, or other circumstances that may affect your treatment, including on any intake form we provide.
• Certain conditions are contraindications for massage. For your safety, we may modify, postpone, or decline a treatment based on the information you provide or on professional judgment.
• You are responsible for the accuracy of the health information you give us. Failing to disclose relevant information may affect your safety and is at your own risk.

9. Respectful conduct

Our therapists and staff are professionals and deserve a safe, respectful environment. Any inappropriate, suggestive, or abusive behaviour will result in immediate termination of the session, full charge for the appointment, and a permanent refusal of service. We are a strictly professional, therapeutic establishment.

10. Gift cards & promotions

Gift cards and promotional offers, where available, are subject to their own terms (for example, expiry dates, eligible services, and no cash value). Promotions cannot be combined unless stated, and we may modify or end a promotion at any time.

11. Website & intellectual property

All content on this website—including text, logos, branding, images, and design—is owned by or licensed to Emerald Massage Clinic & Spa Inc. and is protected by law. You may not copy, reproduce, or reuse it without our written permission. You agree not to misuse the website, attempt to disrupt it, or submit false or automated booking requests.

12. Limitation of liability

To the fullest extent permitted by law, Emerald Massage Clinic & Spa Inc. is not liable for any indirect, incidental, or consequential damages arising from your use of this website or our services. Nothing in these Terms limits liability that cannot be limited under applicable law, including the Consumer Protection Act, 2002 (Ontario). Our services are provided by qualified providers acting in good faith and within their scope of practice.

13. Privacy

We respect your privacy and handle your personal information in accordance with our Privacy Policy and Canada’s Personal Information Protection and Electronic Documents Act (PIPEDA). Please review the Privacy Policy to understand how we collect, use, and protect your information, including sensitive health information.

14. Changes to these Terms

We may update these Terms from time to time. The “Last updated” date at the top shows the most recent version. Continued use of the website or our services after a change means you accept the updated Terms.

15. Governing law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. Any dispute will be handled by the courts located in Ontario, Canada.
